Introduction

Lessons4All is an online Edu-Tech platform that allows users to access freely with the ability to search, compare and book enrichment lessons activity. (Collectively referred to as “Lessons” and the parties providing such lessons are refereed as “Merchants”).

Lessons4All is an online Edu-Tech platform that allows users search, compare, and book lessons offered by our Merchants. It is up to our Merchants to offer their lessons to Lessons4All users and vise versa, it's up to Lessons4All users to accept such lessons from our Merchants. Lessons4All platform helps our Merchants and users connect seamlessly but it does not, nor is it intended to provide any of the lessons or any act that can be construed in any way as an act of providing the services.

1. APPLICATION OF TERMS

1.1 These Terms apply to your use of the Website. By accessing and using the Website:

  • You agree to these Terms; and
  • Where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.

2. CHANGES

2.1 We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the Website, you agree to be bound by the changed Terms.

4.3 You must:

  • not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and
  • unless with our agreement, access the Website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.

4.5 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms, including any failure of a person who accesses and uses our Website by using your User ID.

We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

All other trademarks, trade names, service marks, product names and logos contained herein that are not owned by, licensed to or controlled by us are used in an editorial fashion only, and to the benefit of respective owners with no intention of trademark infringement.

6. DISCLAIMERS

6.1 To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

  • the Website being unavailable (in whole or in part) or performing slowly;
  • any error in, or omission from, any information made available through the Website;
  • any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and
  • any site linked from the Website. Any link on the Website to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable local laws.

7. Create account

7.1 Potential partners/Users that are creating an account over our platform must be at least 18 years old or a majority in your country, if you are not, you may only use the service under the company or supervision of a parent or legal guardian.

7.2 All Platform users are only entitled to one account per person. Any single individual that processes more than one account under its name shall be suspended/terminated and shall not be allowed to access the platform and service upon termination. We reserve the rights to investigate all allegations and fraud activities and take any action that deem necessary to ensure a fair sign up for all partners. When using Lessons4All platform and/Lessons, you are to follow any additional guidelines or rules applicable to specific lessons, activities or features which information may be found from Frequently Asked Question categories time to time.

8. Communication with Lessons4All

8.1 By registering with Lessons4All, you agree to receive certain email and other communications in connection with the Platform and/or lessons activity. For example, you might receive review requests, lessons reservation and cancellation confirmations as well as information sent by Merchants relevant to your booking. Communications relating to your Account will only be sent for important purposes, such as password recovery. You will also receive our email newsletter/telegram group chat from time to time. You can opt-out from receiving our email newsletter by clicking the “Unsubscribe” link at the bottom of the e-mail / or leave the telegram chat.

8.2 Users will not be able to opt-out from receiving important email from Lessons4All or its Merchants related to an active booking or to the users account, Such as lessons reservation and cancellation/rescheduling request.

8.3 Users can customise its notification preferences in their user account settings, Users can opt or opt out from certain email notifications, mobile text, or telegram notifications.

8.4 After confirming a booking, Users will have the possibility to contact a Merchants by email to inquire about the lessons, The reply from the partner will be received in Lessons4All chatbox and a notification will be sent to you.

9. Booking of lessons activity/ communication with Merchants.

9.1 Users may search for Merchants’s lessons and view related information about lessons types or packages and Merchants profile information such as location, price, credibility, and any related information such as what to expect of the lessons package or any other offering.

9.2 Lessons4All may also feature some of our Merchants’s lessons as an advertisement on our platform or on any other social media channel, however this action may not be a recommendation or endorsement of such service. We make no representation of guarantees on the quality or nature of the Merchant's lessons activity.

9.3 Lessons4All encourage our Merchants, that is a must to update their information such as lessons details and availability on a regular basis. However We make no representation of guarantees on the quality of the information provided on Merchants’s lessons activity.

9.4 Upon payment booking process you will enter a lock in period of that particular lesson activity of your interest that you have selected for a period of time. Upon a successful payment there will be confirmation by Lessons4All within 24 hours, you will be able to view your “booking details status” and contact our Merchants for more information if required.

9.5 You may book lessons in advance depending on the Merchant's availability. A confirmed lesson can be rescheduled depending on Merchants’s cancellation and rescheduling policy. In any scenario, lessons must be completed within 2 months from the initial reserved date. we reserve the rights to change, remove or add Merchants and/or service with or without notice to you or liability to us. (Details of cancellation and refunds refer to point 16.)

10. Communication with partners

10.1 Lessons4All’s onsite integration chat at our platform allows users and Merchants to reach out to one another for any queries before making a booking.

10.2 We do not allow and encourage both parties to exchange personal information such as email and phone number through our chat feature.

10.3 Users and Merchants are not allowed to use the chat feature to initiate a transaction directly outside Lessons4All’s platform.

10.4 Chat systems will be monitored between users and Merchants for future quality and customer satisfaction purposes.

11. Purchasing and payment of lessons

11.1 You may purchase single/multiple individual or package lessons at the price displayed on each lesson page. When you purchase a lesson with a credit card, We will process your payment immediately, or hold the credit card number and charge the card for the lesson activity that you chose and notify you of the purchase. In addition if you have chosen a different payment method such as “Paynow” we will instant notify you of your purchase within 24 hours of confirmation.

11.2 You must provide us with an accepted payment method that is currently valid (as “payment method” may be updated from anytime) to use our platform service, in addition by using this service, you agree to pay us the individual purchase price through the payment method. This does not waive our right to seek payment directly from you through any other method, In the event if the payment method was rejected. You may edit your payment information at your users dashboard account (Payment & Subscription).If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information, you remain responsible for any unpaid purchases and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing date. We use third party payment service providers to facilitate your Payment Method. The terms of your payment will be based on your Payment Method and may be determined by agreement between you and your financial institution, credit/debit card issuer or other provider of your selected Payment Method. We disclaim all liabilities associated with the security of the Payment Method. You shall be responsible to resolve any disputes with your financial institution, credit/debit card issuer or other provider of your selected Payment Method.

11.3 Your purchase of Lessons is inclusive of applicable taxes where required by law. You agree that your fee shall be subject to all prevailing statutory taxes, duties, fees, charges and/or costs, however denominated, as may be in force and in connection with any future taxes that may be introduced at any point of time. You further agree to use your best efforts to do everything necessary and required by the relevant laws to enable, assist and/or defend us to claim or verify any input tax credit, set off, rebate or refund in respect of any taxes paid or payable in connection with the Service.

11.4 Purchases are subject to the refund policy set by the Partner after the lesson activity had been conducted. If your purchase is not refundable from the refund policy set by our partners, we will not be able to assist in the refund or credit for any partially used or unused activities unless you provide credible evidence to us to prove that you have been wrongly billed or such other circumstances on a “case to case” basis as we may decide in our sole and absolute discretion. Purchases cancelled or have yet conducted by the Partner will be fully refunded.

12. Member grade Points and Promo code.

12.1 All Member grade starts from Bronze. Point system remains the same across all member grades of $1 Dollar spent = 1 point in your users account.

12.2 Our points redemption system various few types of coupon exchange depending on the level of Member grade that ranges from (Bronze, Sliver, Gold, VIP)

  • Sliver = minimum of 1000 Points (valid member of 1 year) - Awarded every month - $5 coupon - Min spend of $150
  • Gold = minimum of 2000 Spent (Valid for 3 months) - Awarded every month- $15 coupon -min spend of $500 and $5 - Min spend of $150
  • VIP = Minimum of 3000 Spent (Valid for 3 Months) - Awarded every month - $20 Coupon min spend of $600 - $10 coupon - min spend of $400 - $5 coupon - min spend of $150 - $5 coupon - min spend of $150.

Both Gold and VIP member grade valid for 3 months upon reaching its minimum spent, Users can retain their member grade if they were to hit their minimum spend of that particular grade within 3 months of the window period.

12.3 Member grade points and promo code is not transferable, exchangeable, convertible or redeemable for cash.

12.4 Member grade points and promo code may not be combined or accumulated with other offers or promo codes depending on its Terms and condition of that promo code.

12.5 Promo code may only be used pursuant to the specific terms that we establish for such promo code and you must enter the promo code into the “Promo Code” field prior to completing the order.

12.6 Under our Referral program, If you refer a friend to sign up for an account with us, you will be rewarded with a referral fee as reflected on your users account and you may use such referral fee to offset your next payment. A referral fee is only granted when the person referred activates its profile, book a lesson activity at our platform and complete it.

12.6 There will be no limitation to the number of referrals that you can make. You can refer as many friends as you like as long as the referral policy/program is still in effect.

12.7 All Promo Codes are only available in singapore, Example - A promo code worth $5, is only applicable in singapore, whether for the person who shared the promo code or the person who redeemed the promo code.

12.8 We reserve the right to withhold, deduct or remove credits or other features or benefits obtained through the use of promo code by you or any other user in the event that we determine or believe that the use or redemption of the promo code was in error, fraudulent, illegal or in violation of the applicable promo code terms or these Terms.

12.9 We reserve the right to change, suspend, cancel and/or waive the promo code and its applicable terms at any time and from time to time in our sole and absolute discretion without notice to you or liability to us.

13. Users Content and Feedbacks

13.1 You may rate your experience gained from the Lessons and/or write a free-text review. By posting your rating and/or review on the Platform, you grant us an irrevocable, worldwide, royalty-free, non-exclusive, perpetual, sub-licensable and transferable license to use, reproduce, publish, list information regarding,translate, distribute, remove, publicly perform or display, and make derivative works of your rating and/or review in whole or in part, in any form, media or technology, whether now known or hereinafter developed for any purposes, including for the purpose of marketing and promoting Lessons4All and the Platform and/or Lessons in any media formats and through any media channels, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity. We may, in our sole and absolute discretion, choose to monitor, review or remove your rating and/or review if we think your rating and/or review has violated these Terms.

13.2 If you provide us with any comments, feedback, bug reports, or modifications proposed or suggested by you to the Platform and/or Service (“Feedback”), we have the right to use such Feedback in our sole and absolute discretion. You grant us an irrevocable, worldwide, perpetual, royalty-free, non-exclusive, sub-licensable and transferable license to incorporate and use your Feedback for any purposes.

13.3 If you provide us with other forms of user content, whether in textual, audio and/or visual form, click interest/pattern, location, including submission of entries for competitions and promotions, such user content remains your property. However, by providing user content to us, you grant us an irrevocable, perpetual, royalty-free, worldwide, non-exclusive, sub-licensable and transferable license to use, reproduce, modify, publish, list information regarding, edit, remove, translate, distribute, publicly perform or display, and make derivative works of your user content in whole or in part, in any form, media or technology, whether now known or hereinafter developed for any purposes, including for the purpose of marketing and promoting Lessons4All and the Platform and/or Lessons in any media formats and through any media channels, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

13.4 You represent and warrant that: (i) you either are the sole and exclusive owner of all user content or you have all rights, licenses, consents and releases necessary to grant us the license to the user content as set forth above; and (ii) neither the user content nor your submission, uploading, publishing or otherwise making available of such user content nor our use of the user content as permitted herein will infringe, misappropriate or violate a third party’s intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

13.5 You agree to not provide user content that is defamatory, libellous, pornographic, unlawful, hateful, violent, obscene, or otherwise offensive, as determined by us in our sole and absolute discretion, whether or not such material may be protected by law. We may, but shall not be obligated to, review, monitor, or remove user content, in our sole and absolute discretion and at any time and for any reason, without notice to you or liability to us. We may decide to block or cancel your account if you infringe these terms.

14. LIABILITY

14.1 To the maximum extent permitted by law:

  • you access and use the Website at your own risk; and
  • we are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, the Website, or your access and use of (or inability to access or use) the Website. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.

14.2 Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the Singapore Unfair Contract Terms Act 1994 or any applicable consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to SGD 100.

14.3 To the maximum extent permitted by law, our total liability to you under or in connection with these Terms, or in connection with the Website, or your access and use of (or inability to access or use) the Website, must not exceed SGD 100.

15. SUSPENSION AND TERMINATION

15.1 Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it).

15.2 On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

16. Cancellation and rescheduling policy

16.1 The applicable policy is clearly displayed to the customer on the service offer, on the booking confirmation and on the booking notification. Customer/users must make sure he/she reads, understands and accepts the policy before processing a booking.

16.2 There will be no refunds (either in the form of money or credit) for purchased services that are not cancelled before the stipulated deadline or that you did not attend (no-show). There will also be no refunds for any partially used or unused service unless you provide credible evidence to us to prove that you have been wrongly billed.

16.3 Within 48 hours / Refund request before the activity.
Users will be encouraged to reschedule with Merchants instead of cancelling on the booked event. However in the event where users want to cancel the booked event, Users will be able to file a refund request If it's within 48 hours. Lessons4All will process the refund which will take 7days if the payment method is made through “paynow”, However If the payment method is made through Credit/Debit card, it would solely depend on how long your finance institution to process the application. However once it crosses the 48 hour mark, All refund policies and conditions will be followed to our respective merchant accordingly. Lessons4All will do its best to ensure the process is being expedited. Lessons4All website will then indicate to our Merchant to receive such notice/decision made by the users.
Users can reschedule a booking directly in the system before the deadline specified by the policy. Users can reschedule a booking less than 1 day before the event start time, subject to Merchants' agreement. An event not rescheduled or cancelled before the start time of the event will be fully charged to the users.

Refund request after activity
Any refund request from the Users after the activity booked date, The users may submit it’s refund request to the respective Merchant accordingly. Refund request after activity will not be liable under Lessons4All, We will Step in to initiate a contact with the Merchant to ensure users feedback or request is being heard so to ensure there is a proper service handover. If there isn’t any form of interaction with the users within 2 weeks the Merchant’s existing payment may remain held and Lessons4All shall step in for investigation for further action if required.
16.3.1 Users are encouraged to reschedule with partners instead of filling for cancellation due to an unforeseen weather change in disrupting the service experience that was signed up for. Users may contact Lessons4All’s partners through our platform’s “Message Me” function in their users dashboard to relook into the rescheduling of the event. Otherwise, as stated in the following T&C Clause of 16.3 of the Cancellation and Rescheduling Policy will take place as mentioned.

16.4 Lessons4All reserve the rights to change, suspend, cancel or waive the cancellation and rescheduling policy at any time in our sole discretion with or without notice to you or liability to us.

16.5 Lessons4All reserve the rights to temporarily/permanently suspend or terminate your account without compensation to you and/or prevent your access to our platform and/or service if you are found to have violated Lessons4All’s policy multiple times.

16.6 Should users face unforeseen circumstances anytime before/during the day of the event, users can email Lessons4All the details and related documents to request for an exceptional cancellation. Lessons4All will have the final right to judge and decide on the user’s cancellation outcome on a case to case basis.

  • Example of exceptional case:
    - Death or serious illness of customer or immediate family members
    - Safety concerns due to the condition of intended venue of service

    • Allows you to access and use Lessons4All platform
    • Allows you to communicate with our Merchants
    • Improve users operating experience and protect its data while performing analytics and conducting relevant research on Lessons4All platform.
    • Provide better customer service
    • Send users security alert and account notification with usual service or support message through updates.
    • We process your information with your referral invitation, send your request for reference, for fraud detection and prevention and for any purpose you authorize at the time of collection
    • Lessons4All operate, protect and improving its experience and personalize with special customization to your experience (such as making service/courses suggestion, ranking search result) and facilitate experience with our partners and experience with other similar partners programs or service, we conduct profiling based on your recent interaction with Lessons4All platform, your search and booking history, your profile information and preference and other content you submit to Lessons4All platform and enable your use of our enterprise products.

    Lessons4All processes such personal information for the purpose of giving legitimate interest in improving Lessons4All platform with our users and partners experience with it. where it is necessary for the adequate performance of the contract with you
  2. Maintain and create a trusted and safer environment (so to comply with our legal obligation and ensure compliance with Lessons4All policies)
    • Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity,
    • Conduct security investigation and risk assessments,
    • Verify or authenticate information or identification provided by your (such as phone number, Whatsapp OTP, and email that you provide)
    • Conduct checks against database and other information sources, including background or police checks, to the extent permitted by applicable laws and with your consent where required,
    • Comply with our legal obligations,
    • Resolve any disputes with any of our partners and enforce our agreements with third parties,
    • Enforce our terms of service and other policies and,
    • In connection with the activities above, we may conduct profiling based on your interaction with the Lessons4All platform, your profile information and other content you submit to the Lessons4All platform, and information obtained from third parties, in limited cases automated processes may restrict or suspend access to the Lessons4All platform if such processes detect activity that we think pose a safety or other risk to the Lessons4All platform our community or third parties if you challenge the decisioning based on the automated process please contact us a provided in the contact us section below.
    • We process this personal information for these purpose given our legitimate interest in protecting the Lessons4All Platform to measure the adequate performance of our contract with you and to comply with applicable laws

  3. Provide, personalize, measure and improve our advertising and marketing.
    • Lessons4All may send you promotional messages, marketing, advertising and other information that may be of interest to you based on your preference including information about Lessons4All or partnering campaigns and services and social media advertising through social media platforms such as facebook and/or google.
    • Lessons4All will be able to manage referral programs, reward surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Lessons4All or its third party partners.
    • Conduct profiling on your characteristics and preferences (Based on the information you provide to us your interaction with the Lessons4All platform, information obtained from third parties and your search and booking history, may send you promotional messages, marketing advertising and other information that we think may be of interest to you.
    • Enrolling in an email subscription will not affect the frequency of administrative emails that we may send in connection with any Lessons4All account. No fee is charged for sending promotional emails to you, but third-party data rates may apply. Note that you may not be able to take advantage of certain promotions if you do not have a Lessons4All account
    • Invite you to events and relevant opportunities (example: when you share about a related experience on an event (not limited to), we may use that information provided to promote relevant events that will be happening)

  4. How the payments data controller uses the personal information collected.
    • We may use the personal information as part of payment service such as to:
      - Enable you to access and use the payment service
      - Detect and prevent fraud, abuse, security incidents, and other harmful activity.
      - Conduct security investigations and risk assessments.
      - Conduct checks against databases and other information sources
    • Both users and Merchants have to always comply with the local legal obligation such as anti-money laundering regulation and any other related legal obligation locally.
    • Lessons4All will be able to enforce the payment terms and other payment policies on users and vendors when required
    • Lessons4All reserve the rights to send promotional messages, marketing and advertising materials and related information to users based on Your preferences and consent.

19. Sharing & Disclosure

  1. Advertising and social media, sharing with your consent.
    • Where you have provided consent, we share your information, including personal information, as described at the time of consent, such as when you authorize a third party application or website to access your users account or when you participate in promotional activities conducted by Lessons4All partners or third parties.
    • Where permissible according to applicable law we may use certain limited personal information about you, such as your email address, contact number, to hash it and to share it with social media platforms , such as facebook, google, self marketing channel or third parties, to generate leads, drive traffic to our website or otherwise promote our product and service or the Lessons4All platform. These processing activities are based on our legitimate interest in undertaking marketing activities to offer users a better product or service that may be of your interest.
    • The social media platforms with which we may share your personal information are not controlled or supervised by Lessons4All. Therefore any question regarding your social media platform service provider processes your personal information should be directed to such provider. However given your information if were used in Lessons4All self marketing platform. We will only disnimate your information which you consented during your registration of account, based on your recent interest where it was found from your browsing experience at our site, to related third parties or our Merchants so to ensure we are able to offer you a better product or service that may be of your interest.
    • Please note that you may, at anytime ask Lessons4All to cease processing your data for these direct marketing purposes by sending a request to Lessons4All’s email at [email protected]

  2. Sharing between members
    • To help facilitate bookings or other interaction between members, we may need to share certain information, including personal information with other members, as it is necessary for the adequate performance of contract between you and us as follows:
      - When you as a user submits a booking request, certain information about you is shared with our Merchants, including your profile, name, your cancellation history, and other information you agree to share. When your booking is confirmed, we will disclose additional information to assist with coordinating the activity that was registered with the sole purpose of a smooth completion of service, Example
        - Name and photo: For our Merchants to verify you
        - Address: for our Merchants to conduct lessons at your place.
        - Mobile number: For our Merchants to reach out to you for any further queries in relation to your booking
      - When you as our Merchants have confirmed booking, certain information is shared with the user to coordinate the activity such as your profile, name, phone number, experience and address.
      - When you as users initiate a group payment booking request certain information about each participant such as first name, last initial, profile picture as well as booking details is shared among all participants of the group payment booking request.
      - Lessons4All does not share any of the website’s user billing history and payout information with other users.

  3. Profiles, listings, and other information.
    • Lessons4All lets you publish information, including personal information, that may be visible to the general public. For example: Parts of your public profile page, such as your company name, your company description and the location of your company are publicly visible to others.
    • Listing pages are publicly visible and including information such as the experience of your activity offered, or business location( where you have provided your consent) listing description, calendar availability, your company public profile photo, aggregated demand information (page view over a period of time), and any additional information you choose to share.
    • After completing a booking, users may write reviews and rate on the service or activity that was experienced. Reviews and rating are part of your public profile page and may also be surfaced elsewhere on Lessons4All platform (such as listing page or home page)
    • Only comment if you were a customer of the school / class and refrain from commenting based on third-party, external, word-of-mouth reviews. You should not give comments that are deemed as rude, untruthful or excessively biased.
    • Support your feedback with actual examples/experience. Unsupported claims and irrelevant comments, especially excessively biased, defamatory and misleading ones, will be deleted.
    • Reviews that are written in an attempt to frame merchants that are listed on Lessons4All’s website, and/or to obtain refund, compensation or any inappropriate demand from merchants will not be published.

20. Complaints

In the event of dispute with users, Lessons4All will help to our best extent, within the terms of uses to mediate and resolve the dispute. We are not party to any agreement, dealing or transaction entered into between Merchants and users, whether as a result directly or indirectly, from using the service and we disclaim any and all responsibilities and/or liabilities arising from such agreement between Merchants and the users or vise versa.

If a dispute arises between you and Lessons4All, Our objective is to provide you with a neutral and cost-effective means of resolving the dispute swiftly. Accordingly you and Lessons4All at this instant agree that we will resolve any claim or controversy at law or equity that arises out of the Terms of use or platform and/or Service in agreement with this section or as you and we otherwise agree in writing. Before last resorting to the filing of a formal lawsuit, We strongly encourage you first to contact us directly to seek resolution via email at [email protected]. We will consider reasonable requests to the best of our ability to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration as alternatives to litigation.

Lessons4All is an online Edu-Tech platform that allows users to access freely with the ability to search, compare and book enrichment lessons activity. (Collectively referred to as “Lessons” and the parties providing such lessons are refereed as “Merchants”).

Lessons4All is an online Edu-Tech platform that allows users search, compare, and book lessons offered by our Merchants. It is up to our Merchant to offer their lessons to Lessons4All users and vise versa, its up to Lessons4All users to accept such lessons from our Merchant. Lessons4All platform helps our Merchants and users connect seamlessly but it does not, nor is it intended to provide any of the lessons or any act that can be contrued in any way as an act of providing the services.

1. APPLICATION OF TERMS

1.1 These Terms apply to your use of the Website. By accessing and using the Website:

  • You agree to these Terms; and
  • Where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

6. Lessons4All Edu-Tech Platform

6.1 Lessons4All Will provide a platform to you under this agreement. Our platform constitutes the provision of a edu-technology platform that allow you, as an independent third party provider “Merchants” access to and use of our website to the following

  • arrange and schedule delivery of lessons activity with end-users of those service who have an agreement with lessons4All (Users/Customers)
  • Determine the amount to be paid by the users/customer to you for the lessons activity that was provided by you
  • facilitate receipt of payment from users/customers for service offered by you at our platform and generation of receipts for those payments

6.2 Lessons4All platform is available for the sole purpose for your commercial use, Unless Lessons4All has agreed with you otherwise in a separate agreement. all Merchants (You) acknowledge there is no employment of contract between yourself and Lessons4All and that you will conduct your lessons activity as an independent contractor. You too acknowledge that Lessons4All does not provide any of the service/Lessons activity that you offer or function as a provider of any particular service or activity to customer/users via Lessons4All platform. Lessons4All accepts liability for our platform that it provides to you subject to this term and Lessons4All acts and only acts as a Edu-tech platform that allows our Merchants to list their lessons activity offered to users who can compare and booked, You are solely responsible for the service that you provide to the users/customers.

6.3 you agree and acknowledge that these Terms do not constitute an or any employment agreement or contact between you and Lessons4All. You will use our platform to offer your lessons activity and any other related services to our users/customer as an independent contractor. You will not seek and Lessons4All will not provide any supervision, control or direction over any individual lessons activity that you offer to the users/customers. You will obtain and possess at your own cost and at all times, while accessing and using our platform, the necessary approval/licenses/tax registrations required to offer your lessons activity to the users/customers

7. DISCLAIMERS

7.1 To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

  • the Website being unavailable (in whole or in part) or performing slowly;
  • any error in, or omission from, any information made available through the Website;
  • any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and
  • any site linked from the Website. Any link on the Website to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

8.1 Potential Merchants that are creating an account over our platform must be at least 18 years old or a majority in your country, if you are not, you may only use the service under the company or supervision of a parent or legal guardian.

8.2 All Platform users are only entitled to one account per person. Any single individual that processes more than one account under its name shall be suspended/terminated and shall not be allowed to access the platform and service upon termination. We reserve the rights to investigate all allegations and fraud activities and take any action that deem necessary to ensure a fair sign up for all Merchants. When using Lessons4All platform and/Lessons, you are to follow any additional guidelines or rules applicable to specific lessons, activities or features which information may be found from Frequently Asked Question categories time to time.

9. Communication with Lessons4All

9.1 By registering with Lessons4All, you agree to receive certain email and other communications in connection with the Platform and/or lessons activity. For example, you might receive a review statement, lessons reservation and cancellation confirmations as well as information sent by customers relevant to your listing. Communications relating to your Account will only be sent for important purposes, such as password recovery. You will also receive our email newsletter/telegram group chat from time to time. You can opt-out from receiving our email newsletter by clicking the “Unsubscribe” link at the bottom of the e-mail / or leave the telegram chat.

9.2 You will not be able to opt-out from receiving important email from Lessons4All or related to an active booking to the users account, Such as lessons reservation and cancellation/rescheduling request.

9.3 Merchant can customise its notification preferences in his users account settings.

9.4 After confirming a booking, Merchants may be expecting a message from the customer, if they have any queries on the service activity. Merchants are required to reply customer queries through our chatbox at our platform with a notification sent to you.

10. Booking of lessons activity/ communication with Merchants.

10.1 Merchants may expect users to reach out to them on any queries related to their service that was offered at our platform.

10.2 Lessons4All may also feature some of our Merchant’s lessons as an advertisement on our platform or on any other social media channel, however this action may not be a recommendation or endorsement of such service. We make no representation of guarantees on the quality or nature of the Merchant’s lessons activity.

10.3 Lessons4All encourage our Merchants, that is a must to update their information such as lessons details and availability on a regular basis. However We make no representation of guarantees on the quality of the information provided on Merchant’s lessons activity.

10.4 Merchants may expect an advance booking from the customer, and they may follow their terms and policy If there were any reschedule or cancellation upon a confirmed lessons between Merchants and our customer. The lessons must be completed within 2 months from the initial reserved date. We Reserve the rights to change, remove or add Merchants and/or service with or without notice to you or liability to us. (Details of cancellation and refunds regers on point 19)

11. communication with Merchants and on chat system

11.1 Lessons4All’s onsite integration chat at our platform allows users and Merchants to reach out to one another for any queries before making a booking.

11.2 We do not allow and encourage both parties to exchange personal information such as email and phone number through our chat feature.

11.3 Users and Merchants are not allowed to use the chat feature to initiate a transaction directly outside Lessons4All’s platform.

11.4 Chat systems will be monitored between users and Merchants for future quality and customer satisfaction purposes.

11.5 By signing up with Lessons4All, you agree to receive certain email and other communication in connection with the platform and/or service. For example, you might receive review requests, Lessons reservation and cancellation confirmations as well as information relevant to your booking. Communication relating to your account will only be sent for important purposes such as password recovery, payment request or notice. You will also receive our email newsletter from time to time. you can opt out from receiving our email newsletter by clicking the unsubscribe link at the bottom of the email.

12. Users Content and Feedbacks

12.1 users may rate their experience gained from the Lessons provided by you and/or write a free-text review. By posting having rating and/or review on the Platform, you grant us an irrevocable, worldwide, royalty-free, non-exclusive, perpetual, sub-licensable and transferable license to use, reproduce, publish, list information regarding,translate, distribute, remove, publicly perform or display, and make derivative works of your rating and/or review in whole or in part, in any form, media or technology, whether now known or hereinafter developed for any purposes, including for the purpose of marketing and promoting Lessons4All and the Platform and/or Lessons in any media formats and through any media channels, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity. We may, in our sole and absolute discretion, choose to monitor, review or remove your rating and/or review if we think your rating and/or review has violated these Terms.

12.2 If users provide us with any comments, feedback, bug reports, or modifications proposed or suggested by users or you to the Platform and/or Service (“Feedback”), we have the right to use such Feedback in our sole and absolute discretion. You grant us an irrevocable, worldwide, perpetual, royalty-free, non-exclusive, sub-licensable and transferable license to incorporate and use your Feedback for any purposes.

12.3 If users provide us with other forms of Merchant content, whether in textual, audio and/or visual form, click interest/pattern, location, including submission of entries for competitions and promotions, such user content remains your property. However, by providing user content to us, you grant us an irrevocable, perpetual, royalty-free, worldwide, non-exclusive, sub-licensable and transferable license to use, reproduce, modify, publish, list information regarding, edit, remove, translate, distribute, publicly perform or display, and make derivative works of your user content in whole or in part, in any form, media or technology, whether now known or hereinafter developed for any purposes, including for the purpose of marketing and promoting Lessons4All and the Platform and/or Lessons in any media formats and through any media channels, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

12.4 You represent and warrant that: (i) you either are the sole and exclusive owner of all user content or you have all rights, licenses, consents and releases necessary to grant us the license to the user content as set forth above; and (ii) neither the user content nor your submission, uploading, publishing or otherwise making available of such user content nor our use of the user content as permitted herein will infringe, misappropriate or violate a third party’s intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

12.5 You agree to not provide user content that is defamatory, libellous, pornographic, unlawful, hateful, violent, obscene, or otherwise offensive, as determined by us in our sole and absolute discretion, whether or not such material may be protected by law. We may, but shall not be obligated to, review, monitor, or remove user content, in our sole and absolute discretion and at any time and for any reason, without notice to you or liability to us. We may decide to block or cancel your account if you infringe these terms.

13. LIABILITY

13.1 To the maximum extent permitted by law:

  • you access and use the Website at your own risk; and
  • we are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, the Website, or your access and use of (or inability to access or use) the Website. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.

13.2 Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the Singapore Unfair Contract Terms Act 1994 or any applicable consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to SGD 100.

13.3 To the maximum extent permitted by law, our total liability to you under or in connection with these Terms, or in connection with the Website, or your access and use of (or inability to access or use) the Website, must not exceed SGD 100.

14. Offering Service on Lessons4All

14.1 All Merchants must clearly describe their lessons offered in terms of time,price, location, restriction, any equipment required, and prerequisite if any. You should specify what is included or non included in each package in detail. While creating the lessons activity, All Merchants have agreed with Lessons4All cancellation and rescheduling policy which will be enforced by Lessons4All. IF a lessons service is misrepresented, the customer complaints. With the agreement with all Merchants any refund/ cancellation before the activity date we may refund fully for the users. However if any refund or cancellation request were submitted after the activity date, Lessons4All will not be liable and will request the relevant Merchants to answer the users/customers where your own refund/rescheduling/cancellation policy applies. 14.2 Merchants who misrepresented their service offer/Lessons activity may have their service or lessons listing and account blocked, removed or cancelled.

14.3 Before offering any of your services with Lessons4All, Please take note of the following services that are not allowed on Lessons4All. They may not be illegal, however they may not fit Lessons4All’s general lessons offering. This is not exhaustive and Lessons4All reserves the right to amend this list at any time with or without notice to you.

  • Service that require specific license such as offering of financial assistance
  • money lender service
  • listing or promoting Multi level marketing programs (MLM) , get rich quick schemes, pyramid selling schemes, ponzi schemes, and commission only schemes.
  • service that shame to others and/or reveal personal information of others
  • service that promotes, supports or glorifies hatred and seeks to discriminate and/or demean on the basis of race, religion, gender, gender identity, sexual orientation, disability.
  • service that promotes, supports or glorifies acts of violence
  • any service that seeks or promotes to engage users in illegal activity in the eyes of laws.
  • adult industry services, including escort services
  • licensed medical and healthcare service

14.4 Merchant’s service of offering will be validated by Lessons4All before their listing can be seen by the users.

14.5 Lessons4All may decide at its own sole and absolute discretion to block/remove a lessons offering listing by a Merchant, A lessons may be blocked while Lessons4All support team contact you to clarify the offering. following our investigation, the service offer and potentially your account may be removed and cancelled.

14.6 Lessons4All do not allow our Merchants to contact any of our users directly with the purpose of transacting directly with them, outside of Lessons4All platform. Similarly our Merchants are not allowed to display their contact details such as phone numbers/ email with the purpose of allowing the user/customer to contact them directly. “All chat communication purpose will be encourage to use our in built integration chat system at our site” Lessons4All may decide at its sole and absolute discretion to block/remove a lesson offer listed by our Merchants if a Merchants is a found or being reported by a user/customer, to contact users/customer for the purpose of transacting service offline or transact service with our users/customer outside Lessons4All platform.

15. Advertising

15.1 We encourage our Merchants to use our platform’s marketing tools to improve their listing and revenue at any point of time.

  • For example “Boosted Coupon” Merchants may purchase boosted coupons on site over their dashboard with no expiry dates. Boosted Rewards Coupon may be rewarded to Merchants over their dashboard upon each initiative that was implemented for the Merchants as according.
  • Activation of Boosted Coupon will be under full discretion of Merchants after reviewing its competition indicated based on the number of competitors activating the coupon within that period of time.
  • Merchants will be able to do on site purchase of advertisements with Lessons4All and use those marketing tools( pop up, banner ads and sliding ads) to better help generate sales leads on their own discretion.
  • Pop up ads and banners ads frequency will be set according to reflecting in users view once to twice per day on each visit. Lessons4All will have the full autonomy to change or amend the frequency with or without informing the Merchants.
  • "Sliding ads" operate on a bidding system that allows the highest bidder to advertise their services on (location on the website). The winning bid will get the ad space for 2 weeks from the time of confirmation. The bidding for the next period of promotion will also happen concurrently (I.E Bidding window is 2 weeks).
  • bottom sliding Fixed banner ads will be placed within the website at the discrepancy of Lessons4All. The content of the advertisement will be displayed randomly with or without relation to the nature of content to Lessons4All and the partnering Merchants.
  • Merchants are granted total freedom of content promoted but also agree to uphold all the terms offered in full integrity. Lessons4All will also not be held liable for any disputes and issues arising from the promotion of content on the platform.

16. Platform Servicing Fee (Merchant)

16.1 Lessons4All serves as a servicing platform for our Merchants to list their available services

16.2 Lessons4All platform will remain free for our Merchants in listing their service. Nevertheless there will still be a servicing fee upon each successful transaction which will only be charged when Merchants submits its withdrawal request.

16.3 Lessons4All will absorb all payment gateway fees

16.4 All Merchants will be able to submit a withdrawal request anytime they want after the safeguard phase of 24 hour, however there will be a standard 12% service fee imposed upon any withdrawal amounting to $300 and above. In the event where Merchants wish to withdraw an amount less than $300, there will be a different standard service fee of 15%. Hence Lessons4All encourages all Merchants to a significant amount of funds before making a withdrawal to best help merchants maximize its profit/engagement and ROI on our platform. All Merchant will receive a payment notice/receipt through their registered email and on our Merchants dashboard as a form of documentation with each withdrawal.

16.5 We reserve the rights to amend or change our servicing fee and its terms at any time with the company’s absolute discretion with notice or without any liability to us.

16.6 Lessons4All standard servicing Fee as of 1_ Sept _ 2020 is 12% and a maximum of 15%.

16.7 The platform fee on specific service offered may be different from these terms and are agreed in a separate agreement with our Merchants which may supercede this terms.

17. Our Merchants Payment

17.1 Lessons4All will be collecting all customer’s payments on behalf of our Merchants, as an act of protection of any unforeseen circumstances. Payment will be held until services/activity are completed. Funds / Revenue are not to be used to run Lessons4All’s operations, but to be safeguarded under the Merchant’s account until the merchant’s wishes to do a withdrawal request of the available fund / revenue.

17.2 Merchants will be able to submit a withdrawal request anytime the merchant wishes for a withdrawal, however the Merchants must ensure the payment for that particular activity/class has been conducted before they can request a withdrawal.

17.3 Payment will be transferred to the Merchant’s registered bank account after 3 - 5 working days upon receiving a withdrawal request, after deduction of platform fees and any penalties if applicable.

17.4 All Payment invoices will be sent over via the Merchant’s registered email address and dashboard for Merchants monitoring.

17.5 In the event of dispute or cancellation with customers/users, we encourage our Merchants to resolve this on their own. If the problem is not solved before the closing week of Sunday 2359 hours, the Merchant’s existing payment may remain held until the following week and Lessons4All shall step in for investigation for further action if required.

17.6 Lessons4All reserve the rights to change our payment schedule at any time in our sole and absolute discretion with or without notice to you or liability to us.

18. SUSPENSION AND TERMINATION

18.1 Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it).

18.2 On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

19. Cancellation and rescheduling policy

19.1 The applicable policy is clearly displayed to the customer on the service offer, on the booking confirmation and on the booking notification. Customer/users must make sure he/she reads, understands and accepts the policy before processing a booking.

19.2 There will be no refunds (either in the form of money or credit) for purchased services that are not cancelled before the stipulated deadline or that you did not attend (no-show). There will also be no refunds for any partially used or unused service unless you provide credible evidence to us to prove that you have been wrongly billed.

19.3 Within 48 hours / Refund request before the activity.
Users will be encouraged to reschedule with Merchants instead of cancelling on the booked event. However in the event where users want to cancel the booked event, Users will be able to file a refund request If it's within 48 hours. Lessons4All will process the refund which will take 7days if the payment method is made through “paynow”, However If the payment method is made through Credit/Debit card, it would solely depend on how long your finance institution to process the application. However once it crosses the 24 hour mark, All refund policies and conditions will be followed to our respective merchant accordingly. Lessons4All will do its best to ensure the process is being expedited. Lessons4All website will then indicate to our Merchant to receive such notice/decision made by the users.
Users can reschedule a booking directly in the system before the deadline specified by the policy. Users can reschedule a booking less than 1 day before the event start time, subject to Merchant' agreement. An event not rescheduled or cancelled before the start time of the event will be fully charged to the users.

Refund request after activity
Any refund request from the Users after the activity booked date, The users may submit it’s refund request to the respective Merchant accordingly. Refund request after activity will not be liable under Lessons4All, We will Step in to initiate a contact with the Merchant to ensure users feedback or request is being heard so to ensure there is a proper service handover. If there isn’t any form of interaction with the users within 2 weeks the Merchant’s existing payment may remain held and Lessons4All shall step in for investigation for further action if required.
19.1.1 Users are encouraged to reschedule with Merchants instead of filling for cancellation due to an unforeseen weather change in disrupting the service experience that was signed up for. Users may contact Lessons4All’s Merchants through our platform’s “Message Me” function in their users dashboard to relook into the rescheduling of the event. Otherwise, as stated in the following T&C Clause of 20.3 of the Cancellation and Rescheduling Policy will take place as mentioned.

19.4 Lessons4All reserve the rights to change, suspend, cancel or waive the cancellation and rescheduling policy at any time in our sole discretion with or without notice to you or liability to us.

19.5 Lessons4All reserve the rights to temporarily/permanently suspend or terminate your account without compensation to you and/or prevent your access to our platform and/or service if you are found to have violated Lessons4All’s policy multiple times.

19.6 Should users face unforeseen circumstances anytime before/during the day of the event, users can email Lessons4All the details and related documents to request for an exceptional cancellation. Lessons4All will have the final right to judge and decide on the user’s cancellation outcome on a case to case basis.

  • Example of exceptional case:
    - Death or serious illness of customer or immediate family members
    - Safety concerns due to the condition of intended venue of service

    • Conduct checks against database and other information sources, including background or police checks, to the extent permitted by applicable laws and with your consent where required,

    • In connection with the activities above, we may conduct profiling based on your interaction with the Lessons4All platform, your profile information and other content you submit to the Lessons4All platform, and information obtained from third parties, in limited cases automated processes may restrict or suspend access to the Lessons4All platform if such processes detect activity that we think pose a safety or other risk to the Lessons4All platform our community or third parties if you challenge the decisioning based on the automated process please contact us a provided in the contact us section below.

    • Enrolling in an email subscription will not affect the frequency of administrative emails that we may send in connection with any Lessons4All account. No fee is charged for sending promotional emails to you, but third-party data rates may apply. Note that you may not be able to take advantage of certain promotions if you do not have a Lessons4All account
    • Invite you to events and relevant opportunities (example: when you share about a related experience on an event (not limited to), we may use that information provided to promote relevant events that will be happening)

22. Sharing & Disclosure

  1. Advertising and social media, sharing with your consent.
    • Where you have provided consent, we share your information, including personal information, as described at the time of consent, such as when you authorize a third party application or website to access your users account or when you participate in promotional activities conducted by Lessons4All Merchants or third parties.
    • Where permissible according to applicable law we may use certain limited personal information about you, such as your email address, contact number, to hash it and to share it with social media platforms , such as facebook, google, self marketing channel or third parties, to generate leads, drive traffic to our website or otherwise promote our product and service or the Lessons4All platform. These processing activities are based on our legitimate interest in undertaking marketing activities to offer users a better product or service that may be of your interest.
    • The social media platforms with which we may share your personal information are not controlled or supervised by Lessons4All. Therefore any question regarding your social media platform service provider processes your personal information should be directed to such provider. However given your information if were used in Lessons4All self marketing platform. We will only disnimate your information which you consented during your registration of account, based on your recent interest where it was found from your browsing experience at our site, to related third parties or our Merchant so to ensure we are able to offer you a better product or service that may be of your interest.

  2. Sharing between members
    • To help facilitate bookings or other interaction between members, we may need to share certain information, including personal information with other members, as it is necessary for the adequate performance of contract between you and us as follows:
      - When a user submits a booking request, certain information about you is shared with our users, including your profile, name, your cancellation history, and other information you agree to share. When your booking is confirmed, we will disclose additional information to assist with coordinating the activity that was registered with the sole purpose of a smooth completion of service, Example
        - Name and photo: For our users to verify you
        - Address: for our users to know where is the location to conduct lessons/ or at the users place/ online.
        - Mobile number: For our users to reach out to you for any further queries in relation to your booking
      - When you as our Merchant have confirmed booking, certain information is shared with the user to coordinate the activity such as your profile, name, phone number, experience and address.
      - When you as users initiate a group payment booking request certain information about each participant such as first name, last initial, profile picture as well as booking details is shared among all participants of the group payment booking request.
      - Lessons4All does not share any of the website’s user billing history and payout information with other users.

  3. Profiles, listings, and other information.
    • Lessons4All lets you publish information, including personal information, that may be visible to the general public. For example: Parts of your public profile page, such as your company name, your company description and the location of your company are publicly visible to others.
    • Listing pages are publicly visible and including information such as the experience of your activity offered, or business location( where you have provided your consent) listing description, calendar availability, your company public profile photo, aggregated demand information (page view over a period of time), and any additional information you choose to share.
    • After completing a booking, users may write reviews and rate on the service or activity that was experienced. Reviews and rating are part of your public profile page and may also be surfaced elsewhere on Lessons4All platform (such as listing page or home page)
    • Only comment if you were a customer of the school / class and refrain from commenting based on third-party, external, word-of-mouth reviews. You should not give comments that are deemed as rude, untruthful or excessively biased.
    • Support your feedback with actual examples/experience. Unsupported claims and irrelevant comments, especially excessively biased, defamatory and misleading ones, will be deleted.
    • Reviews that are written in an attempt to frame merchants that are listed on Lessons4All’s website, and/or to obtain refund, compensation or any inappropriate demand from merchants will not be published.

23. Complaints

In the event of dispute with users, Lessons4All will help to our best extent, within the terms of uses to mediate and resolve the dispute. We are not party to any agreement, dealing or transaction entered into between Merchant and users, whether as a result directly or indirectly, from using the service and we disclaim any and all responsibilities and/or liabilities arising from such agreement between Merchant and the users or vise versa.

If a dispute arises between you and Lessons4All, Our objective is to provide you with a neutral and cost-effective means of resolving the dispute swiftly. Accordingly you and Lessons4All at this instant agree that we will resolve any claim or controversy at law or equity that arises out of the Terms of use or platform and/or Service in agreement with this section or as you and we otherwise agree in writing. Before last resorting to the filing of a formal lawsuit, We strongly encourage you first to contact us directly to seek resolution via email at [email protected]. We will consider reasonable requests to the best of our ability to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration as alternatives to litigation.
